I'm not sure. If I was, I'd be a lawyer...and rich. All I know is that it's treated like a private adoption, she files the paperwork, one of the bigoted judges here recuses herself because she thinks it's wrong, and it gets refiled and then gets approved.
I think it only happens because no one really knows about it. If it was public knowledge, the fundies would come down on the city raining their hellfire and brimstone on us for such a thing.
